Terms and Conditions
Last updated: 4 November 2026
These terms apply to all web design, development, hosting, maintenance and SEO services provided by Tris Digital ("we", "us") in Perth, Western Australia. By accepting a quote, paying an invoice or starting a hosting subscription you agree to them. If we have agreed something different in writing, that written agreement takes priority over these terms.
1. Quotes and projects
Project work is described in a written quote or proposal, including the scope, price and timeline. Quotes are valid for 30 days unless they say otherwise. Work outside the agreed scope, including major changes after sign-off, will be quoted separately before we begin.
We rely on you to supply content, images, feedback and access to accounts in good time. Delays on your side may move the launch date.
2. Project payments
Project fees are payable in the stages set out in your quote. Invoices are due within 14 days of the invoice date unless the quote says otherwise. We may pause work on a project while an invoice is overdue.
3. Hosting and maintenance subscriptions
Hosting and maintenance are provided as a recurring subscription, billed in advance for each billing period (monthly or annually, as set out in your quote or plan).
Billing through Stripe. Subscription payments are processed by Stripe. When you start a subscription you authorise us, through Stripe, to charge your chosen payment method automatically at the start of each billing period until you cancel. We never see or store your full card details; they are handled by Stripe under its own terms and privacy policy. Please keep your payment details current.
Failed or overdue payments. If a payment fails, Stripe may retry it and we will contact you using the email address on your account. If a subscription payment remains unpaid 7 days after the due date, we may suspend your hosting, which means your website and any related services we host for you may be taken offline (deactivated) until the overdue amount is paid in full.
Unpaid and unresponsive accounts. If a managed web hosting bill remains unpaid and we receive no response after multiple attempts to contact you about it (for example by email and phone), we will give you 7 days' written notice that your website will be deactivated. If the overdue amount is still unpaid at the end of that notice period, we may deactivate your website.
We will give you notice by email before suspending a service. Once all overdue amounts have been paid, we will restore the website as soon as reasonably possible. We are not responsible for any loss of business, revenue or traffic while a website is suspended for non-payment.
If an account remains unpaid for 30 days after suspension, we may cancel the subscription and, after giving you a further written notice, permanently delete the hosted site and its backups. Suspending or ending hosting does not affect your ownership of your content or your domain name.
Price changes. We may change subscription prices by giving you at least 30 days' written notice. The new price applies from the next billing period after the notice period ends. If you do not accept it, you may cancel before it takes effect.
4. Cancellation
You may cancel a hosting or maintenance subscription at any time by giving us written notice (email is fine). Cancellation takes effect at the end of the billing period you have already paid for. We do not provide refunds for part-used billing periods, except where required by law.
On request, we will give you a copy of your website files and database so you can move to another host. Reasonable help with a handover is included; extensive migration work will be quoted separately.
5. Ownership and intellectual property
Once a project has been paid for in full, you own the bespoke design and content we created for you. Until then we retain ownership and you may not use it live.
Third-party software remains subject to its own licence, for example frameworks, content management systems, plugins, themes, fonts or stock images used on your site. Some of these may carry ongoing licence fees, which we will tell you about in advance.
You give us permission to describe the project and show screenshots of the finished website in our portfolio and marketing, unless you ask us not to in writing.
6. Your responsibilities
You confirm that the content you supply is yours to use and does not break any law or anyone's rights, and that you will keep your account logins and payment details secure. You must tell us promptly if you suspect a security problem with your site or accounts.
7. Availability and third parties
We use reasonable care to keep hosted websites secure and online, but we do not guarantee uninterrupted service. Hosting relies on third-party providers (for example server and data centre providers and payment processors), and outages or changes outside our control may affect your site. Scheduled maintenance will be carried out in a way that minimises disruption where possible.
8. Limits on our liability
Nothing in these terms excludes or limits any rights you have under the Australian Consumer Law or other laws that cannot be excluded.
Subject to that, and to the extent the law allows, we are not liable for indirect or consequential loss, including loss of profit, revenue, data or business opportunity. Our total liability for any claim relating to our services is limited to the amount you paid us for those services in the 12 months before the claim arose.
9. Privacy
We handle personal information as described in our privacy policy.
10. Changes to these terms
We may update these terms from time to time. The version on this page applies from the date shown at the top. For ongoing subscriptions, we will tell you about material changes by email in advance.
11. Governing law
These terms are governed by the laws of Western Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Western Australia.
